2. ALL LICENSED CONTRACTORS MUST DISPLAY THE CSLB, CONTRACTORS STATE LICENSE BOARD LICENSE NUMBER ON VEHICLES AND ALL DOCUMENTS including Web Sites and Social Media sites. (Business and Professions Code Section 7027.1)

Every consumer should verify with the CSLB that an individual or company is in fact a Registered Licensed Contractor before employing their services. The CSLB issues unique number protocols to classify each trade, so verifying a Contractor is in fact licensed is easy and quick.

3. ALL LICENSED CONTRACTORS MUST HAVE AN “ACTIVE” STATUS WITH THE CSLB, CONTRACTORS STATE LICENSE BOARD BEFORE COMMENCING WORK for any Residential or Business consumer (Business and Professions Code 7114)

Before agreeing with any individual for services or goods and accepting an individual’s word that they possess an ACTIVE Contractors License every consumer must check with the CSLB to validate the individual’s license before employing their services.

4. ALL LICENSED CONTRACTORS MUST HAVE LIABILITY, BONDING, AND WORKERS COMPENSATION INSURANCE (Business and Professions Code 7071.6)

Before entering into any agreement for goods or services with any individual that claims to be a licensed Contractor, ALWAYS check the Active status of their insurance policies with the California Department of Insurance, and ask to see the actual policy number, agents name, and company issuing the polices. If an individual or company does not have Liability Insurance when an accident or tragedy occurs the financial burden to repair a consumer’s property or pay for medical expenses comes out of the wallet of the consumer or their insurance company.

5. ALL SERVICE TECHNICIANS, INSTALLERS, SALES or MARKETING EMPLOYEES MUST BE LICENSED WITH THE CSLB, CONTRACTORS STATE LICENSE BOARD (Business and Professions Code 7152)

ANY Employee who works for a Licensed Contractor that solicits, sells, negotiates, or executes contracts for home improvement goods or services must be licensed with the CSLB, Contractors State License Board as a HOME IMPROVEMENT SALESPERSON.

6. ALL CONTRACTORS MUST PROVIDE A WRITTEN HOME IMPROVEMENT CONTRACT TO EVERY CONSUMER WHEN SOLICITING BUSINESS OVER A $500.00 AMOUNT (Business and Professions Code 7159)

ANY Licensed Contractor, their employees, or affiliates who solicits offers to a consumer for goods or services over the cost of $500.00 must submit a Home Improvement Contract to the consumer in advance before they exchange any goods or work, or they start services.

The Home Improvement Contract serves as a written proposal to establish a business agreement with a consumer. The Home Improvement Contract must also inform the property owner or consumer of their legal rights under the terms and conditions of the contract, and the Contractors’ rights. Other terms will include the Contractors License Number, the Contractors Liability Insurance Carrier Information, the Contractors Workers Compensation Statement, the 3-Day Right To Cancellation Statement, Mechanics Lien Notification, Right To Arbitrate for dispute settlement and a Change Order Addendum if the original Contract price exceeds 35% of the quoted total price.

ANY LICENSED OR UNLICENSED CONTRACTOR WHO DOES NOT PROVIDE A HOME IMPROVEMENT CONTRACT IN ADVANCE BEFORE COMMENCING WORK VIOLATES THE CONTRACTORS LAWS OF THE STATE OF CALIFORNIA!

7. ALL CONTRACTORS MUST PROVIDE A WRITTEN SERVICE AND REPAIR CONTRACT TO EVERY CONSUMER WHEN PROVIDING GOODS OR SERVICES (Business and Professions Code 7159.10)

ANY Licensed Contractor, their employees, or affiliates who provides a consumer with goods or services over the cost of $95.00 must submit a Service and Repair Contract to the consumer in advance before they can offer any goods, work, or services.

Service and Repair Contracts serve as a written agreement between the Contractor and a consumer, and the maximum dollar amount of this Contract cannot exceed $750.00. A Contractor may not offer any additional goods or services to the consumer is not within the immediate scope of work the consumer requested.

Contractors may not ask for any DOWN PAYMENT or advance payment. Contractors must provide visual evidence of any parts, fixtures, or equipment replaced during the repair or installation. Also, the Contractor must get a written statement from the consumer that the Contractor can remove the old parts from the consumer’s premises.

Service and Repair Contracts must also inform the property owner or consumer of their legal rights under the terms and conditions of the contract, and the Contractor’s rights. Other terms of the written contract will include the Contractors License Number, the Contractors Liability Insurance Carrier Information, the Contractors Workers Compensation Statement, and the 3-Day Right To Cancellation Statement.
